12.0 CLASSES OF MISCONDUCT

12.1 HOCKEY MISCONDUCT (CLASS I MISCONDUCT)

A Class I Misconduct relates to:

12.1.1 Any game related infraction committed by players or bench personnel contrary to the rules of play established by Hockey Canada, the Ontario Hockey Federation or the Alliance Hockey of Ontario for which on-ice officials can assess penalties and suspensions; and, 

12.1.2 Any infraction by any member or hockey participant of the CYO Rules for which sanction is prescribed in those rules.

12.2 Any infractions recorded on a game sheet which is signed by the on ice-officials of the game in which the infraction was incurred are non-reviewable.

12.3 Exception: Any infraction recorded as or relating to Hockey Canada's Maltreatment Rules will be forwarded to the Alliance for review and possible further suspension if warranted.

12.4 The CYO Rules may provide for additional discipline and sanction for Class I infractions, which shall be in addition to the sanctions required by Hockey Canada, the Ontario Hockey Federation or Alliance Hockey of Ontario.  

12.5 GENERAL MISCONDUCT (CLASS II MISCONDUCT)

A Class II Misconduct may include the following:

12.5.1 Any behaviour which is contrary to any CYO or Alliance Hockey Codes of Conduct which may be in effect when the conduct occurred;
12.5.2 Any threatening, intimidating or assaultive behaviours which does not amount to abuse or bullying as defined by the Hockey Canada Maltreatment policy;
12.5.3 Any harassment of any other individual other than a CYO hockey Participant who is a child or youth;
12.5.4 Any failure to adequately account for monies collected for hockey purposes;
12.5.5 Any repeated and persistent failure to communicate relevant information required to allow a hockey participant to participate in games, practices and other hockey events;
12.5.6 Any persistent pattern of Class I Misconduct which appears to demonstrate a total disregard for the relevant hockey rules;
12.5.7 Any intentional action or failure to act which potentially places the heath and welfare of any hockey participant at risk but does not amount to abuse or neglect; or,
12.5.8 Any behaviors which constitute a breach of any interim directions given pursuant to the outcome of a Disciplinary Review or the terms of any disciplinary Sanctions imposed pursuant to a Disciplinary Review.
 
12.6 MISCONDUCT DIRECTED AT YOUTH (CLASS III MISCONDUCT)

A Class III Misconduct within these By-laws includes any alleged abuse, bullying, harassment, or neglect occurring in any context related to CYO Hockey activities.

12.7 If any individual within CYO Hockey observes or becomes aware of any behaviors which cause them concern and that individual is are uncertain if the concerning behaviors constitutes misconduct with the definition of that term within these By-laws, the consulted person should impartially listen to the person reporting the concerning behaviors and shall encourage the person reporting the behavior to submit an Incident report through the CYO website to be reviewed by the Director of Risk.
